The EC Regulation 1244/2009 of the Council of 30 November 2009 amending Regulation (EC) No 539/2001 establishing the list of countries whose nationals must be in possession of visas when crossing the external borders and the list of third countries whose nationals are exempt from this requirement. These changes are rendered necessary by the admission of Serbia, Macedonia and Montenegro in Schengen white list.

On 1 January 2008 came into effect the agreements on visa facilitation with five Western Balkan countries (Albania, Bosnia-Herzegovina, Macedonia, Montenegro and Serbia), which represented a first step towards a visa-free regime. With each of these countries has been initiated a process to arrive at the liberalization of visas, a journey to be realized through a Road Map drawn up for this purpose.

The evaluation on the implementation of the roadmaps in May 2009, the Commission concluded that Macedonia has met all the benchmarks set out in its schedule and, in the assessment of November 2009, that Montenegro and Serbia comply with all parameters set by their respective roadmaps.
